1. Acceptance of these terms
These Terms and Conditions form an agreement between you and Nisha Spark. By creating an account or using our website or mobile application (the "Service") you accept these terms and our Privacy Policy. If you do not accept them, do not use the Service.
2. Eligibility — 18+ only
You must be 18 years of age or older to register or use the Service. By using Nisha Spark you confirm that you are an adult and legally able to enter into this agreement. Accounts found to belong to minors are terminated immediately and permanently.
3. What Nisha Spark is
Nisha Spark is a social networking and communication platform for making new friends through audio and video communication. The platform is for social networking only. It is not a dating service and it is not an adult service. We do not provide, promote or permit any adult content or services of any kind.
4. Your account
- Provide accurate registration details and keep them up to date.
- Keep your password confidential; you are responsible for activity on your account.
- One person may not operate multiple accounts to evade restrictions.
- Do not impersonate another person or use someone else's photo as your profile photo.
- Do not sell, transfer or share your account with anyone else.
5. Community rules and prohibited conduct
You must not share abusive or objectionable content. The following are strictly prohibited on the Service:
- Abuse, harassment, threats, hate speech, bullying or discriminatory behaviour.
- Nudity, sexual content, obscene gestures or any adult content in calls, photos or text.
- Solicitation of any kind, including offering or requesting paid personal services, escort services, or moving members off-platform for such purposes.
- Content involving minors in any form.
- Violence, self-harm promotion, illegal drugs, weapons or other unlawful activity.
- Spam, scams, phishing, chain messages, advertising or promotion of other services.
- Requesting or collecting money, financial details, OTPs or bank information from other members.
- Recording, screenshotting, downloading or redistributing another member's call, voice or image without their consent.
- Attempting to hack, reverse engineer, scrape, overload or bypass any security control, billing rule or coin deduction of the Service.
6. Virtual coins
- Coins are a virtual in-app utility used to enable premium features such as extended audio and video chat time and virtual gifts.
- Coins are non-refundable and have no real-world cash value. They are not money, not a deposit, not a stored-value instrument and not a security.
- Coins are credited instantly on successful payment and are consumed as you use premium features, at the rates displayed in the app.
- Coins are personal to your account, cannot be transferred or resold, and cannot be exchanged for cash. Coins in a suspended or deleted account are forfeited.
- We may change coin prices, rates or package contents; changes apply to future purchases and usage.
- Purchases are governed by our Refund & Cancellation Policy.
7. Report and block — user safety
We provide a Report and Block feature for user safety. If someone behaves inappropriately, block them and submit a report from within the app. Our moderation team reviews reports and may warn, restrict, suspend or permanently ban the reported account. Deliberately false reports are themselves a violation of these terms.
8. Suspension and termination
We have the right to suspend, restrict or permanently terminate accounts that violate these rules, that we reasonably believe are engaged in fraud or abuse, or where required by law. This may happen without prior notice where the risk to other members is serious. You may stop using the Service at any time and request deletion of your account by emailing nishaspark68@gmail.com.
9. Content and licence
You keep ownership of the photos and content you upload. You grant us a limited, non-exclusive licence to host, display and transmit that content as needed to operate the Service, and to review it for moderation and safety. You are responsible for having the rights to everything you upload.
10. Availability and third-party services
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. Call quality depends on your device and internet connection. Payments are processed by Razorpay and calling is delivered through third-party real-time infrastructure; their availability is outside our control.
11. Disclaimer and limitation of liability
The Service is provided on an "as is" and "as available" basis. We do not verify the statements members make about themselves and we are not responsible for the conduct of any member, whether online or offline — use your own judgement and never share financial details. To the maximum extent permitted by law, our total liability arising from your use of the Service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses.
12. Indemnity
You agree to indemnify Nisha Spark against claims, losses and expenses arising from your breach of these terms or your misuse of the Service.
13. Changes to these terms
We may update these terms from time to time. The "Last updated" date shows the current version, and continued use of the Service after an update means you accept the revised terms.
14. Governing law
These terms are governed by the laws of India, and the courts at Andhra Pradesh, India have exclusive jurisdiction over any dispute.
